Terms of Service

The terms that govern the use of escLab and the purchase of its plans.

These terms govern your use of escLab, published by Wissem Hadhri — Entrepreneur individuel (EI) — micro-entreprise, régime micro-BNC, 66 avenue des Champs-Élysées, 75008 Paris, France, SIREN 101 759 082 — Registre National des Entreprises (RNE). Creating an account or subscribing to a plan means accepting them.

1. What the service is

escLab is an online service, used through a web browser, providing historical statistics on futures trading sessions (Nasdaq 100, S&P 500, gold). It measures, over past sessions, how often the market behaviours defined by its modules occurred.

Free plan (account required): Research (reports, confluences, combinations), the modules and their dashboards, Edge Accuracy and the glossary. Starter plan (paid subscription): in addition, the replay Terminal: any past session played back bar after bar, with its levels and their probability. Details are on the Pricing page.

Accounts are opened by invitation, from a waitlist. Market data consists of past sessions, updated periodically; the service provides no real-time data.

2. Disclaimer — no investment advice

The information provided by escLab consists of statistics about the past, for information and educational purposes. It is not investment advice, not a personal recommendation and not a trading signal, nor a solicitation to buy or sell any financial instrument. Past results do not guarantee future results.

Trading futures carries a high risk of loss, which may exceed the capital committed. You alone are responsible for your trading decisions and their consequences. Wissem Hadhri is neither an investment firm nor a financial adviser, and executes no orders.

3. Accounts

Some features require an account, created through our authentication provider. You are responsible for keeping your credentials confidential. One account is for one person.

4. Plans, prices and billing

Current plans and prices are shown on the Pricing page. There are two plans: Free and Starter. Starter is billed monthly or annually and renews automatically unless cancelled beforehand. Payment is processed by Stripe; we never receive or store your card details.

Prices are net: the publisher is under the French VAT exemption scheme (non applicable — art. 293 B du CGI (franchise en base de TVA)); the price shown is the price paid.

5. Right of withdrawal

If you are a consumer resident in the European Union, you have fourteen (14) days from subscription to withdraw, without giving any reason and without penalty.

Access is opened immediately on payment. By ticking the box on the Pricing page, you expressly request that the service begin during the withdrawal period, and acknowledge that you will owe an amount in proportion to what has been supplied until you withdraw.

To withdraw, send an unambiguous statement to contact@esclab.h2wi.fr before the fourteen days expire. You may use the model form below, but you do not have to. Any refund due — the price paid, less the amount proportionate to the service supplied — is made within fourteen days of receipt, using the payment method you used, at no cost to you.

The right of withdrawal applies to the initial subscription: automatic renewal does not start a new period. The free plan involves no payment and therefore no right of withdrawal.

6. Cancellation and suspension

You can cancel at any time from “My account” (billing portal). Cancelling stops the next renewal; access continues until the end of the period already paid, which is not refunded pro rata — a situation distinct from the right of withdrawal in section 5.

We may suspend an account for non-payment, and terminate it immediately for a serious breach, in particular a use contrary to section 7.

7. Prohibited use

  • circumventing your plan limits, authentication or any technical limitation;
  • disrupting the service or attempting to access other users’ data;
  • using the service for unlawful purposes, or reselling access without written permission;
  • automatically or systematically extracting the service’s statistics, data or content, or republishing them.

8. Availability

We do our best to keep the service available at all times, without any service-level guarantee. Maintenance interruptions may occur.

9. Liability

We are bound by an obligation of means. Our aggregate liability for any claim arising from a paid plan is limited to the amount paid over the twelve months preceding the event. Nothing excludes liability that cannot lawfully be excluded, in particular towards consumers.

10. Personal data

Processing of your data is described in the Privacy Policy.

11. Changes

We may amend these terms. Any change is published on this page with the date at the top updated. Material changes affecting a paid plan are notified before they take effect.

12. Mediation, language and governing law

These terms are published in French and in English; in the event of a discrepancy, the French version prevails. French law applies. Complaints: contact@esclab.h2wi.fr.

If a dispute remains unresolved, consumers may refer it free of charge to a consumer mediator.

Failing an amicable resolution, the French courts have jurisdiction, subject to the mandatory protective rules applicable to consumers.
